SMS Terms & Conditions

These SMS Terms and Conditions ("Terms") govern your subscription to and use of our SMS messaging service ("Service"). By subscribing to or using the Service, you agree to these Terms provided by the following brand names: Nsite, National Scoliosis Clinic, MyBackHub, The Scoliosis Solution (“Company”). Please read them carefully.

1. Acceptance of Terms

By subscribing to our SMS service, you agree to comply with and be bound by these Terms, our Privacy Policy, and the Program and Service Terms and Conditions (Section 4 below) if the SMS content relates to any program or service. If you do not agree to these Terms, you should not subscribe to or use the Service.

2. Subscription

By providing your mobile number and subscribing to our SMS service, you agree to receive text messages from the Company. These messages will come from (855) 461-2257, and the average subscriber can expect to receive less than 4 messages per month. These messages may include updates, promotions, and other content related to our services or products. If you have any questions about your text plan or data plan, it is best to contact your wireless provider. Message and data rates may apply for messages sent from you to us, and from us to you, and carriers are not liable for delayed or undelivered messages.

You can cancel the SMS service at any time. Just text "STOP" to the short code. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

Program/App Terms & Conditions

These Terms and Conditions ("Terms") govern your access to and participation in all programs, tools, and services ("Services") offered by Nsite, Inc., doing business as the National Scoliosis Clinic / MyBackHub ("Company", "we", "us", or "our"). This includes, but is not limited to, the PostureBackNeck Assessment, The Back Pain Solution, The Scoliosis Solution, MyBackHub AI Companion, Live Classes, Empowered Relief®, AI Guided Therapy, and Expert Guided Live Therapy.

1. Acceptance of Terms

By accessing or using any Service, you confirm that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. If you do not agree to these Terms or the Privacy Policy, you may not use the Services.

2. Eligibility

To use the Services, you must be at least 18 years old or have the express consent of a parent or legal guardian. By using the Services, you affirm that you meet these eligibility requirements. Some components of the Services are not intended for children under the age of 13.

3. Medical Disclaimer and No Diagnostic Claims

  • Educational Purpose Only: The Services and content, though informed by clinical research, are provided for informational, educational, and general wellness purposes only and are not a substitute for professional medical evaluation, diagnosis, or treatment.

  • No Diagnosis or Treatment: The PostureBackNeck Assessment and all offerings—including but not limited to AI-guided therapy, treatment plans, Empowered Relief sessions, live expert guidance, use of MyBackHub’s AI Companion, and exercise videos—are not intended to diagnose, treat, cure, or prevent any medical condition. Any findings or observations related to Scoliosis, Kyphosis, or any possible care classifications shared through this service are for informational purposes only and should not be considered a medical diagnosis. Some spine-related conditions may not be detectable through visual assessment and may require further evaluation by a medical professional.

  • Consult a Healthcare Provider: No statements made in the Services constitute medical advice. Any suggestions, exercises, or insights provided through the Services, including by AI companion tools, digital scans, community advice, or instructors, should not replace consultation with a licensed healthcare provider regarding any health issue, including back pain or related symptoms.

  • No Guaranteed Outcomes: Company and its content/technology partners do not guarantee outcomes, improvements, or relief from symptoms.

4. Assumption of Risk and Release of Liability (Crucial)

  • Voluntary Participation: You, the undersigned, voluntarily seek access to the Services. You understand that participation, including in digital assessments, exercise programs (like Live Classes or AI Guided Therapy), and AI-guided therapy, involves inherent risks, including the potential for physical injury, mental or emotional distress, and other unforeseen complications.

  • Assumption of Risk: You expressly and voluntarily assume all such risks, whether known or unknown, including risks related to the musculoskeletal and cardiorespiratory systems.

  • Release of Liability: You waive, discharge, and hold harmless Nsite, Inc (DBA MyBackHub), its subsidiaries, affiliates, parent company, content and technology partners (including, but not limited to, Pilates Teck, Inc, My Medical Hub Corporation, GoHighLevel, Mighty Networks, LainaHealth, Empowered Relief, CustomGPT, Amazon Web Services (AWS)), employees, agents, representatives, contractors, advisors, and AI assistant agents from any and all claims, liabilities, damages, demands, or actions of any nature whatsoever, whether direct or indirect, in law or equity, arising out of or related to your participation in or use of the Services.

5. Emotional and Psychological Well-being

You acknowledge that while the Services may include guidance in pain management, holistic wellness, and mental/emotional well-being, NSite, Inc. (DBA MyBackHub) and all aforementioned parties are not responsible for any emotional or psychological harm, distress, or other non-physical consequences that may arise from participation in any portion of the Services.

6. Description of Core Services

The Services provided may include:

  • PostureBackNeck (PBN) Assessment: An innovative, clinical-grade technology to evaluate posture and spinal alignment, providing data and guiding users toward personalized care plans.

  • The Scoliosis Solution: Community, exercises, and advice designed to help individuals with scoliosis live in freedom from pain.

  • MyBackHub AI Companion / Scoliosis AI Assistant: A 24/7 dedicated assistant for instant, reliable answers to back health questions, program guidance, exercise support, and research updates.

  • Live Classes: Live workout sessions with certified Pilates instructors, focused on core strengthening, elongation, strong spine workouts, postural awareness, and personalized feedback.

  • Empowered Relief®: A self-paced, 80-minute online program (developed at Stanford University) providing science-backed tools to manage pain, calm the nervous system, improve sleep, and boost mood.

  • AI Guided Therapy (via App): A personal digital coach providing a custom plan of targeted stretches and exercises based on PBN Assessment results, with real-time AI feedback via the secure, HIPAA-compliant iOS or Android app.

  • Expert Guided Live Therapy (Virtual PT): Live, virtual care from a licensed physical therapist on a HIPAA-compliant, FDA-registered platform, using advanced computer vision and AI for real-time feedback and personalized, evolving treatment plans.

7. User Accounts and Usage Guidelines

  • Account Responsibility: To access certain features, you may be required to create an account. You agree to provide accurate and complete information and are responsible for maintaining the confidentiality of your login information and all activities under your account.

  • Prohibited Use: You agree not to use the Services: (a) to engage in any illegal activities; (b) to upload any content that infringes on the intellectual property or privacy rights of others; or (c) in any way that could damage, disable, or impair the functionality of the App or Services.

8. Subscription and Payments

The Services may offer subscription-based access. By purchasing a subscription, you agree to pay all associated fees and charges. Subscriptions may automatically renew unless you cancel prior to the renewal date. You are responsible for managing your subscription and renewal settings through the appropriate platform (e.g., website, Apple AppStore, or Google Play Store). Refunds, when applicable, are handled per our Refund Policy.

9. Intellectual Property

All content, trademarks, and other intellectual property rights related to the Services (including the App) are the property of Nsite, Inc. or its licensors. You may not reproduce, distribute, or create derivative works from any content without our express permission.
